1 Acceptance of These Terms

These Terms and Conditions (“Terms”) govern your access to and use of edenglobalsolutions.com and its content, forms, calculator, and other website features. By using the website, you agree to these Terms. If you do not agree, do not use the website. These Terms do not replace a signed proposal, installation agreement, financing agreement, warranty, maintenance agreement, or other project contract. If a signed agreement conflicts with these Terms regarding a project, the signed agreement controls.

2 About Eden and Local Services

Eden Global Solutions LLC, a Kentucky limited liability company, operates the website. Services in the Dominican Republic may be offered or performed through Aletheia Energy SRL or another disclosed affiliate, contractor, or licensed professional. The legal entity identified in your proposal or contract is responsible for that transaction.

3 Permitted Use

You may use the website for lawful personal or business purposes related to evaluating or obtaining our services. You may not interfere with site security or operation; introduce malicious code; scrape, copy, or republish substantial content without permission; misrepresent your identity; submit false or unlawful information; attempt unauthorized access; or use the website to violate another person’s rights or applicable law.

4 Estimates Calculator and Website Information

Website content is general information and may not reflect current equipment availability, prices, utility rules, incentives, tax treatment, permitting requirements, financing terms, or site conditions. Calculator results, savings figures, generation projections, payback periods, system sizes, environmental equivalents, and preliminary prices are estimates based on inputs and assumptions. They are not guarantees, engineering drawings, tax or financial advice, an offer to lend, or a binding quotation.

A formal project requires appropriate evaluation and a written agreement. Final design, price, production, savings, schedule, eligibility, and scope may change after review of utility bills, site conditions, electrical systems, structural conditions, shading, equipment, permitting, interconnection, taxes, financing, or other relevant factors.

Actual solar production, bill reduction, backup duration, and financial results vary. Eden is not a bank or lender unless expressly stated in writing. Financing is subject to a third party’s application, credit review, approval, terms, fees, security requirements, and privacy practices. Links or introductions do not constitute endorsement, approval, or a promise of financing. You are responsible for reviewing and accepting a lender’s documents. Third-party sites, tools, products, and services are governed by their own terms.

7 Quotes Contracts Payments and Taxes

Submitting a form or receiving an automated or preliminary estimate does not create a contract or reserve equipment, pricing, or an installation date. Quotes may expire and may be corrected for errors. The signed agreement governs deposits, payment schedules, cancellation rights, equipment, taxes, permits, interconnection, warranties, and project scope. Tax exemptions, credits, incentives, net-metering benefits, and financing outcomes depend on applicable rules and individual eligibility; consult qualified advisers where appropriate.

8 Intellectual Property

The website and its original text, graphics, designs, photographs, videos, calculators, trademarks, logos, and other content are owned by Eden or used with permission and are protected by applicable law. We grant you a limited, revocable, nonexclusive right to use the website for its intended purpose. No ownership right is transferred. Product and third-party names remain the property of their respective owners.

You represent that your submissions are accurate, lawful, and do not violate another person’s rights. Do not submit confidential designs, trade secrets, or sensitive account or identity information unless we request it through an appropriate channel.

11 Disclaimers

To the fullest extent permitted by law, the website and its general content are provided “as is” and “as available.” Eden disclaims implied warranties concerning the website, including merchantability, fitness for a particular purpose, title, and noninfringement. We do not warrant that the website will always be uninterrupted, error-free, secure, or current. Nothing in these Terms excludes an express warranty contained in a signed project agreement or a right that cannot lawfully be waived.

12 Limitation of Liability

To the fullest extent permitted by law, Eden and its affiliates, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, opportunities, energy savings, or goodwill arising from website use. To the fullest extent permitted by law, total liability arising solely from use of the free website, excluding a signed project agreement, will not exceed US$100. These limitations do not apply where prohibited by law or to liability that cannot lawfully be limited.

13 Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Eden and its affiliates from third-party claims, losses, and reasonable costs arising from your unlawful misuse of the website, your material violation of these Terms, or content you submit that infringes another person’s rights. This section does not apply to the extent a claim results from Eden’s own unlawful conduct or where indemnification is prohibited by law.

14 Availability and Changes

We may modify, suspend, or discontinue website content or features and may update these Terms. Revised Terms take effect when posted unless a later date is stated. Changes do not retroactively alter a signed project agreement.

15 Governing Law and Disputes

For disputes arising solely from use of this website, these Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles. Subject to mandatory consumer laws and jurisdictional requirements, the state and federal courts located in Jefferson County, Kentucky will have exclusive jurisdiction. Transactions performed by Aletheia Energy SRL or another local entity remain subject to the governing-law and dispute provisions in the applicable signed agreement and to any mandatory local law.

16 Miscellaneous

If a provision is unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a reorganization, merger, sale, or transfer of the website or business. These Terms and the Privacy Policy form the entire agreement concerning use of the website, but not concerning a separately contracted project.
